Terms of Service

Please read these terms carefully before using our services.

1. Definitions

In these Terms of Service, the following terms have the meanings set forth below:

  • "Service" or "Platform" refers to the Igniral software-as-a-service platform, including all features, APIs, and related services.
  • "User", "You", or "Your" refers to the individual or entity accessing or using the Service.
  • "We", "Us", "Our", or "Igniral" refers to the operator of the Platform.
  • "Account" refers to the unique account created by a User to access the Service.
  • "Application" refers to API projects created within the Platform.
  • "User Content" refers to data, files, schemas, and configurations uploaded or created by Users.
  • "API Users" refers to end-users of Applications created through Igniral.
  • "Subscription" refers to the paid access tier selected by the User.

2. Acceptance of Terms

By accessing or using Igniral's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not access or use our services.

These Terms constitute a legally binding agreement between you and Igniral. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws
  • Not have been previously suspended or banned from the Platform

If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind such entity to these Terms.

4. Description of Service

Igniral is a software-as-a-service platform that enables users to design, deploy, and manage production-ready REST APIs without traditional backend development. Our services include:

4.1 Core Features

  • Schema Builder: Visual and AI-powered tools for designing API data structures
  • API Generation: Automated creation of RESTful endpoints based on your schemas
  • Data Storage: Secure, managed database storage for your API data
  • File Management: File upload endpoints with integrated malware scanning
  • Access Control: User authentication, role-based permissions, and API key management
  • API Documentation: Auto-generated OpenAPI/Swagger documentation
  • Metrics & Analytics: Real-time monitoring of API performance and usage

4.2 AI-Powered Features

Igniral uses artificial intelligence to assist with schema design and type inference. AI features:

  • Are provided to enhance productivity and are not guaranteed to be error-free
  • Generate suggestions that require user review and approval before implementation
  • Do not replace professional judgment for critical application design decisions

5. Account Registration and Security

5.1 Account Creation

To use our services, you must create an account by providing:

  • A valid email address
  • Your name or organization name
  • A strong password meeting our security requirements

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.

5.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breaches
  • Ensuring that your password meets our minimum security requirements

We strongly recommend enabling Two-Factor Authentication (2FA) for enhanced account security.

5.3 Account Sharing

Account credentials are personal and may not be shared with third parties. Each individual user must have their own account. Sharing account credentials may result in account suspension or termination.

6. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms.

6.1 Prohibited Activities

You agree not to:

  • Violate any applicable local, state, national, or international laws or regulations
  • Infringe upon the intellectual property, privacy, or other rights of third parties
  • Upload, store, or transmit malware, viruses, or other malicious code
  • Attempt to gain unauthorized access to our systems, other users' accounts, or connected networks
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to send spam, phishing attempts, or unsolicited communications
  • Engage in any activity that could damage, disable, or impair the Service
  • Circumvent rate limits, security measures, or access restrictions
  • Resell, sublicense, or redistribute the Service without authorization
  • Use automated tools to scrape, mine, or extract data from the Service beyond normal API usage

6.2 Prohibited Content

You may not use the Service to store, process, or transmit:

  • Content that promotes illegal activities or violence
  • Sexually explicit or exploitative material
  • Content that harasses, threatens, or defames others
  • Content that infringes copyrights, trademarks, or other proprietary rights
  • Personal data collected without proper consent or legal basis

6.3 API Usage Limits

Your subscription tier determines your usage limits, including:

  • Number of Applications
  • Storage capacity
  • API request rate limits
  • Number of API Users per Application

Exceeding these limits may result in service throttling or suspension. We will notify you when approaching limits.

7. Subscriptions and Payments

7.1 Subscription Plans

We offer the following subscription tiers:

  • Free: Limited features for exploration and personal projects
  • Standard ($19/month): For small teams and MVPs
  • Pro ($49/month): For professional developers and startups
  • Enterprise ($149/month): For large organizations with advanced needs

7.2 Billing and Payment

  • Billing Cycle: Subscriptions are billed monthly in advance on the date of initial subscription
  • Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date
  • Payment Methods: We accept major credit cards processed securely through Stripe
  • Taxes: Prices may be subject to applicable taxes based on your location
  • Failed Payments: If a payment fails, we will attempt to collect payment for up to 7 days. If unsuccessful, your account may be downgraded or suspended

7.3 Plan Changes

  • Upgrades: Take effect immediately. You will be charged the prorated difference for the current billing period
  • Downgrades: Take effect at the start of the next billing cycle. Your current plan features remain active until then

7.4 Price Changes

We reserve the right to modify subscription prices. We will provide at least 30 days advance notice of any price changes via email or platform notification. Your continued use of the Service after the price change constitutes acceptance of the new pricing.

7.5 Refund Policy

  • Refunds are provided at our discretion for unused service periods
  • Refund requests must be submitted within 14 days of the billing date
  • No refunds are provided for accounts terminated due to Terms violations
  • The Free tier is non-refundable (no payment required)

7.6 Cancellation

You may cancel your subscription at any time through your account settings. In compliance with applicable consumer protection laws, including Mexico's LFPC, cancellation is designed to be as simple as the subscription process. Upon cancellation:

  • Online Cancellation: Available 24/7 through your account dashboard under Settings → Subscription → Cancel
  • Your access continues until the end of the current billing period
  • Your account will be downgraded to the Free tier (if eligible) or suspended
  • You should export any data you wish to retain before cancellation
  • You will receive email confirmation of your cancellation request

8. Intellectual Property Rights

8.1 Your Content

You retain full ownership of all User Content you create, upload, or store using the Service, including:

  • API schemas and configurations
  • Data stored through your APIs
  • Files uploaded to file endpoints
  • Custom configurations and settings

8.2 License to Igniral

By using the Service, you grant us a limited, non-exclusive, royalty-free license to:

  • Host, store, and process your User Content
  • Transmit your content as necessary to provide the Service
  • Create backups for disaster recovery purposes

This license is solely for the purpose of providing and improving the Service. We do not claim ownership of your content and will not use it for any purpose other than providing the Service.

8.3 Igniral's Intellectual Property

Igniral retains all rights, title, and interest in:

  • The Platform software, source code, and architecture
  • All trademarks, logos, and branding
  • Documentation, tutorials, and instructional materials
  • Any improvements, modifications, or derivative works of the Platform

Nothing in these Terms grants you any right to use Igniral's trademarks, logos, or branding without prior written consent.

8.4 Feedback

If you provide feedback, suggestions, or ideas regarding the Service, you grant us a perpetual, irrevocable, royalty-free license to use, modify, and incorporate such feedback without any obligation or compensation to you.

9. User Content and File Upload Responsibility

9.1 Ownership and Responsibility

You retain all intellectual property rights in, and are strictly responsible for, any data, text, files, or other content you upload, store, or process through Igniral ("User Content"). Igniral does not monitor, review, or endorse User Content and acts merely as a passive conduit for your data distribution and storage.

9.2 Acceptable Use

You agree not to use Igniral to upload, host, or transmit files that:

  • Are illegal, fraudulent, defamatory, or promote illegal activities.
  • Infringe on any third party's intellectual property, copyright, or privacy rights.
  • Contain malware, viruses, or disruptive code (notwithstanding our automated scanning).

9.3 Right to Remove Content

While we have no obligation to monitor User Content, we reserve the right, at our sole discretion and without liability, to remove any files, disable endpoints, or suspend your account if we determine that your files violate these Terms or applicable laws.

9.4 Indemnification for User Content

You agree to defend, indemnify, and hold harmless Igniral, its operator, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with the files and data you upload, store, or process using our services.

9.5 Copyright Complaints (DMCA)

We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied and is accessible on Igniral in a way that constitutes copyright infringement, please notify us at legal@igniral.com. We reserve the right to remove or disable access to infringing material and to terminate the accounts of repeat infringers in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws.

10. Data, Content, and Backups

10.1 Your Responsibilities

You are solely responsible for:

  • The accuracy, quality, and legality of User Content
  • Ensuring your content does not violate any laws or third-party rights
  • Obtaining all necessary consents for personal data you process through the Service
  • Maintaining independent backups of critical data

10.2 Data Processing

When you use Igniral to process personal data of your API Users:

  • You act as the data controller for that data
  • Igniral acts as a data processor on your behalf
  • You are responsible for ensuring compliance with applicable privacy laws
  • You must maintain appropriate privacy notices for your API Users

10.3 Content Moderation

We reserve the right to:

  • Review content that has been flagged for potential violations
  • Remove or disable access to content that violates these Terms
  • Suspend accounts engaged in prohibited activities

We are not obligated to monitor all content but may do so to ensure compliance with these Terms.

10.4 Data Export

You may export your data at any time through the API endpoints of your Applications. We recommend regular data exports for your own backup purposes.

11. Security and Malware Scanning

11.1 Platform Security

We implement industry-standard security measures including:

  • Encryption of data in transit (TLS/HTTPS) and at rest
  • Secure authentication mechanisms
  • Regular security audits and vulnerability assessments
  • Access controls and monitoring

11.2 Malware Scanning

All files uploaded to file endpoints are automatically scanned for malware. Files identified as malicious:

  • Will be rejected and not stored on our servers
  • May result in account review or suspension if patterns of malicious uploads are detected

11.3 Security Incidents

If you discover a security vulnerability in the Service, please report it to security@igniral.com. We appreciate responsible disclosure and will work with you to address the issue.

12. Service Availability and Support

12.1 Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Emergency security updates
  • Factors beyond our control (internet outages, third-party failures, force majeure)

12.2 Service Level

While we aim for high uptime, we do not provide formal Service Level Agreements (SLAs) for standard subscription tiers. Enterprise customers may negotiate custom SLAs.

12.3 Support

Support is provided through:

Response times vary by subscription tier and issue severity.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy or reliability of AI-generated suggestions
  • Warranties regarding third-party services or integrations

You use the Service at your own risk. We do not warrant that the Service will meet your specific requirements.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • Igniral shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption
  • Our total aggregate liability for any claims arising from these Terms or your use of the Service shall not exceed the total amount paid by you to Igniral in the twelve (12) months preceding the claim
  • These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise)

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, the limitations above apply to the fullest extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Igniral and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your User Content or the content processed through your Applications
  • Your violation of any third-party rights

16. Termination

16.1 Termination by You

You may terminate your account at any time through your account settings or by contacting us. Upon termination:

  • Your access to the Service will be revoked
  • You should export your data before deletion
  • Unused subscription fees are non-refundable unless otherwise stated

16.2 Termination by Igniral

We may suspend or terminate your access to the Service immediately, without prior notice, if:

  • You breach any provision of these Terms
  • You engage in fraudulent or illegal activities
  • Your use poses a security risk to the Service or other users
  • Required by law or regulatory authorities
  • Your account remains inactive for an extended period (we will provide notice before termination in this case)

16.3 Effect of Termination

Upon termination:

  • All rights granted to you under these Terms cease immediately
  • You must cease all use of the Service
  • We may delete your account and User Content after a reasonable retention period
  • Provisions that by their nature should survive termination will survive (including Intellectual Property, Limitation of Liability, and Indemnification)

17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Effective Date" at the top of this page
  • For material changes, we will provide notice via email or prominent platform notification
  • Changes become effective upon posting or on the date specified in the notice

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and terminate your account.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Mexico, without regard to conflict of law principles.

18.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved as follows:

  1. Informal Resolution: We encourage you to contact us first at legal@igniral.com to attempt to resolve any dispute informally
  2. Formal Proceedings: If informal resolution is unsuccessful, disputes shall be submitted to the competent courts of Mexico

18.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.

19. Miscellaneous Provisions

19.1 Entire Agreement

These Terms, together with the Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and Igniral regarding the Service.

19.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

19.4 Assignment

You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms without restriction.

19.5 Force Majeure

Neither party shall be liable for any failure or delay in performance due to causes beyond their reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet/infrastructure failures.

19.6 Language

These Terms are provided in English. In the event of any conflict between translated versions and the English version, the English version shall prevail.

20. Disposiciones para México

En cumplimiento con la legislación mexicana aplicable:

20.1 Legislación Aplicable

Estos Términos de Servicio se rigen por las leyes de los Estados Unidos Mexicanos, incluyendo:

  • Código de Comercio
  • Ley Federal de Protección al Consumidor (cuando aplique)
  • Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP)

20.2 Jurisdicción

Para cualquier controversia derivada de estos Términos, las partes se someten a la jurisdicción de los tribunales competentes de la Ciudad de México, renunciando a cualquier otro fuero que por razón de domicilio presente o futuro pudiera corresponderles.

20.3 Derechos del Consumidor

Si usted es un consumidor según la Ley Federal de Protección al Consumidor, los derechos que dicha ley le otorga no se ven afectados por estos Términos. En caso de conflicto entre estos Términos y la legislación de protección al consumidor, prevalecerá la legislación aplicable.

20.4 Protección de Datos

El tratamiento de sus datos personales se realiza conforme a nuestro Aviso de Privacidad, el cual cumple con los requisitos de la LFPDPPP.

20.5 Facturación

Si requiere factura fiscal (CFDI) para sus pagos, puede solicitarla a través de billing@igniral.com proporcionando sus datos fiscales completos (RFC, razón social, domicilio fiscal, régimen fiscal, y uso de CFDI).

20.6 Cancelación de Suscripciones (Ley "Click to Cancel")

En cumplimiento con las reformas al artículo 76 Bis de la Ley Federal de Protección al Consumidor (vigentes desde diciembre 2025), la cancelación de su suscripción es tan sencilla como su contratación:

  • Puede cancelar en línea, las 24 horas, desde su panel de control
  • No requiere llamadas telefónicas ni trámites presenciales
  • Recibirá confirmación inmediata por correo electrónico
  • Su suscripción permanece activa hasta el fin del período pagado
